Supreme Court continues interim relief in Fenkin Infotech LLP Case; Notice Issued in Challenge to Bombay High Court Order

Fenkin Infotech LLP v. Anirudh Nikhil Makecha [Decided on 21.07.2025]

The Supreme Court of India took up a batch of Special Leave Petitions filed by M/s Fenkin Infotech LLP, challenging the final judgment dated March 7, 2025, passed by the Bombay High Court in Writ Petition No. 1915/2025. The petitions pertain to a commercial dispute involving multiple parties, with substantial legal and factual implications.

The matter was heard by a Bench comprising  Justice Pamidighantam Sri Narasimha and Justice Atul S. Chandurkar. Upon hearing the parties, the Court issued notice to the respondents. Notably, the counsel for the respondents accepted notice on record. Importantly, the Supreme Court ordered that the interim relief granted earlier would continue to operate until further orders, thereby maintaining the status quo.

The Court directed that the matter be listed after four weeks, allowing for the filing of responses and additional documents as permitted under multiple interlocutory applications filed alongside the main petitions, including for exemption from filing certified copies and permission to file extensive lists of dates and annexures.

The continuation of the interim order and the engagement of several senior advocates indicate the case’s complexity and potential implications, possibly involving high-stakes contractual or regulatory matters.
