The Supreme Court, hearing a petition concerning alleged deficiencies in services by Indigo Airlines, declined to entertain the Petition, noting that similar issues were already pending before the Delhi High Court.
The case was listed before a Bench led by the Chief Justice of India, with the petitioner appeared in person and senior advocates Mukul Rohatgi and Sandeep Sethi along with team from JSA represented Indigo.
During the hearing, the petitioner highlighted what he described as serious and recurring problems faced by airline passengers, including delays, cancellations and non-refund of fares, contending that a large number of passengers were suffering on a daily basis. He submitted that the issues raised were of public importance and warranted consideration by the Supreme Court.
Senior Advocate Mukul Rohatgi informed the Bench that proceedings on the same subject were already underway before the Delhi High Court and that the Directorate General of Civil Aviation (DGCA) had constituted a committee to examine the concerns raised. He submitted that the petitioner could raise all his grievances and contentions in the pending proceedings before the High Court. He also mentioned that operations are back to normal.
The CJI-led Bench agreed that it would not be appropriate for the Supreme Court to examine the issues at this stage, given the pendency of related matters before the Delhi High Court. The Court accordingly indicated that the petitioner should pursue his remedies before the High Court and did not pass any substantive orders on the merits of the grievances.
