The Supreme Court of India allowed Criminal Appeal filed by the appellant and granted her bail, setting aside the Rajasthan High Court’s order dated 9th April 2025 that had rejected her seventh bail application. The appellant had been in judicial custody since 16th May 2022, in connection with FIR No. 13 of 2022, involving offences triable by a Magistrate.
The Rajasthan High Court had previously denied her bail prompting the appeal to the Supreme Court. When the matter came up before the bench of Justices Manoj Misra and Nongmeikapam Kotiswar Singh, the State’s counsel sought an adjournment to gather further instructions. The Supreme Court, however, declined this request, citing that the State had already been duly served notice and that the petitioner had undergone incarceration for over three years.
Considering the prolonged pre-trial detention and the nature of the offence, which is triable by a Magistrate, the Court observed that continued imprisonment was unjustified. The Court held that the appellant was entitled to bail and directed her release on such terms and conditions as the trial court may impose, based on the circumstances of the case.
