Supreme Court to Commence Hearing Shiv Sena & NCP Factional Disputes; Shiv Sena Matters to Be Taken Up First on January 21, 2026

Shiv Sena dispute

The Supreme Court directed that the batch of petitions arising from the factional disputes within the Shiv Sena and the Nationalist Congress Party (NCP) be listed for hearing on January 21, 2026, at 11:30 A.M.

A Bench of Justice Surya Kant and Justice Joymalya Bagchi passed the directions after identifying two distinct clusters of cases concerning rival groups within the two political parties, namely Shiv Sena and NCP. Since several legal issues may overlap across both groups, the Court directed that the Shiv Sena matters would be taken up first.

Laying down the time structure for arguments, the Court allotted three hours to the petitioners and two hours to the respondents, leaving it to the parties to distribute the time internally among their arguing counsel. The Bench also directed nodal counsel from both sides to ensure streamlined preparation and filing of convenience compilations. These compilations must be filed one week before the scheduled hearing.

The Court also recorded the withdrawal of Contempt Petition No. 528 of 2024, after counsel for the petitioners chose not to press the matter.

With these directions, the Registry has been instructed to list the entire batch on January 21, 2026, at 11:30 a.m., beginning with the Shiv Sena matters, followed by the NCP disputes.
