The Supreme Court dismissed a Special Leave Petition filed by M/s Jai Ambey Emergency Services (I) Pvt. Ltd., declining to interfere with the judgment of the Chhattisgarh High Court in a tender dispute involving emergency services.
The dispute pertained to the award of a government tender, valued at approximately ₹500 crore, in favour of EMRI Green Health Services (EMRI). The petitioner challenged the tender process, alleging that certain conditions were tailor-made to favour EMRI and that the award lacked fairness despite multiple participants at the pre-bid stage.
Appearing for the petitioner, Sr Adv Manu Singhvi contended that the eligibility conditions and evaluation criteria were structured in a manner that effectively ensured issuance of the Letter of Intent (LOI) to EMRI.
Opposing the plea, counsel for EMRI submitted that the allegations were factually incorrect and that modifications to the tender conditions had been made at the instance of the petitioner itself. It was further argued that although the petitioner was eligible, it chose not to participate in the tender and approached the Court only after the LOI had been issued and the process had substantially progressed.
After hearing the parties, the Bench comprising Justice Vikram Nath and Justice Sandeep Mehta observed that it was not inclined to interfere with the impugned judgment/order of the High Court, and accordingly dismissed the Special Leave Petition.
All pending applications were also disposed of.
