Supreme Court Refuses to Interfere with Bombay High Court Order on Action Against Delinquent Police Officers

Gurudutt Kamath v. State of Maharashtra, Decided on 20.03.2026

Supreme Court

The Supreme Court has declined to interfere with an order of the Bombay High Court concerning disciplinary action against delinquent police officers, thereby affirming the High Court’s directions in the matter.

A Bench of Justices Vikram Nath and Sandeep Mehta dismissed a Special Leave Petition challenging the Bombay High Court’s order, observing that it was not inclined to interfere with the impugned judgment. The Court granted permission to file the petition and condoned the delay, but ultimately refused to grant any relief.

The impugned High Court order had recorded the outcome of an inquiry conducted by senior police authorities, wherein recommendations were made for recovery of ₹50,000 each from two delinquent officers and stoppage of their increments for two years. It had also directed that the final decision taken by the Director General of Police be communicated to the petitioner.

With the dismissal of the SLP, the Supreme Court has effectively upheld the High Court’s approach in ensuring accountability through departmental proceedings against the concerned officers.
