A criminal writ petition has been filed before the Bombay High Court seeking quashing of an FIR and subsequent chargesheet against Gurmeet Singh Sunder Singh Jolly, popularly known as “Shera,” in connection with alleged threats made during a phone call.
The petition challenges an FIR registered at Khar Police Station under Sections 509, 507, 504 and 506 of the IPC, as well as the chargesheet pending before a Bandra court. Shera was accused of issuing threats and abusive remarks in an alleged phone call in October 2017.
The petitioner contends that the case is “false and deserves to be quashed,” submitting that there is no documentary or forensic evidence linking him to the alleged call. It is specifically submitted that call transcripts do not establish the identity of the caller, and no forensic voice analysis report has been produced to substantiate the allegations.
The plea further claims that the complaint is a “concocted story” aimed at defaming the petitioner, adding that even the chargesheet lacks legally admissible material. The petition also raises concerns over the absence of call detail records (CDR) and certification requirements under the evidentiary law.
Seeking interim relief, the petitioner has urged the High Court to stay further proceedings before the trial court, arguing that continuation of the case would cause irreparable harm pending adjudication of the writ petition.
