Bribe Demand Proof Corruption Case

A Special Court at Rouse Avenue, Delhi, has acquitted a former Ministry of Home Affairs official and two private individuals in a corruption case relating to the procurement of bulletproof jackets for Central Paramilitary Forces, holding that the prosecution failed to establish demand and acceptance of illegal gratification.

The Central Bureau of Investigation (CBI) had alleged that the public servant entered into a criminal conspiracy with private parties to secure an undue advantage in the tender process. It was claimed that a bribe of ₹10 lakh was demanded and routed through intermediaries, disguised as legitimate transactions to conceal its illegal nature.

During trial, the prosecution relied on electronic evidence, financial records, recovery of cash and jewellery, and witness testimonies. However, the defence contended that the case lacked credible proof, pointing out that key witnesses had turned hostile and that there was no clear evidence of demand or acceptance of bribe an essential requirement under the Prevention of Corruption Act.

The Court observed that mere suspicion or recovery of money is insufficient for conviction in the absence of clear proof of demand and acceptance. It noted inconsistencies in witness testimonies and held that the prosecution failed to establish a reliable money trail or conclusively link the accused to any corrupt act.

It was further found that there was no evidence showing that any undue favour was extended in the tender process. The Court also held that the electronic and documentary evidence was not sufficient to prove the alleged conspiracy.

Accordingly, holding that the prosecution failed to prove its case beyond reasonable doubt, the Court extended the benefit of doubt and acquitted all accused persons.
