The Dwarka Courts in Delhi on September 9th, 2025 allowed a bail application where the accused was arrested under the Narcotic Drugs & Psychotropic Substances Act 1985 (NDPS) for the possession of drugs. The Court justified the bail due to completion of investigation and chargesheet with no further incriminating substances pending against the accused.
On 23rd June, 2025 accused no. 1 and 2 were found to be in alleged possession of 3.124 kg of contraband substance leading to their arrest on the same day. Furthermore, a 9.164 kg of ganja was also recovered from the rented premises of accused no. 2 after his disclosure and both accused were in custody since then.The counsel for the accused argued that the charges were falsely implicated on both the accused who were under arrest and custody since 24th June,2025.On the contrary the prosecution opposed the bail on the grounds that offence was commercial and grave in nature.
As the investigation stood complete, no further recovery of contraband was made from either of the accused, and the charge sheet had already been filed, Judge Bhavna Kalia found no reason to deny bail. The Court cited Chandan Kumar vs. State (NCT of Delhi) and directed the accused to furnish bail bonds of ₹30,000/- with a surety of the like amount, releasing them with a caution against repeating the offence. Consequently, the bail application was allowed and disposed of, with a copy of the order directed to be furnished to the Jail Superintendent for information and compliance.
