‘Legal Research’ No Justification for Laches; Delhi High Court Refuses to Condon 1-Year Delay

The Delhi High Court has dismissed a petition filed under Section 482 of the Code of Criminal Procedure on the ground of inordinate delay, holding that a litigant’s claim of requiring time for “understanding the order” and conducting legal research does not constitute sufficient cause.

Justice Swarana Kanta Sharma refused to condone a delay of over one year in challenging a Sessions Court order that had discharged an accused and quashed the summoning order against him. The petitioner, appearing in person, had argued that the delay occurred due to his difficulty in comprehending the impugned order and the time spent researching the legal position.

Rejecting this explanation, the Court held that such grounds are untenable, particularly when raised by a practising advocate. The Court observed that legal research and consultation are routine exercises and cannot justify prolonged inaction. Accepting such reasons, the Court cautioned, would render the requirement of showing “sufficient cause” meaningless.

The Court further clarified that even though no specific limitation period is prescribed for petitions under Section 482 CrPC, they must still be filed within a “reasonable time.” It reiterated that the doctrine of delay and laches applies equally to such petitions, and unexplained delay can bar relief.

Noting that the petitioner failed to provide any cogent, stage-wise explanation for the delay or demonstrate due diligence, the Court held that the reasons offered were mere excuses rather than a valid justification.

Accordingly, the application for condonation of delay was dismissed, and the underlying petition was rejected as being barred by delay and laches.
