In a criminal contempt case before the Delhi High Court wherein the Court was of the opinion that the respondent advocate’s conduct had brought down the majesty of law in the eyes of the public and had interfered with the administration of justice, a Division Bench of Justice Subramonium Prasad and Justice Harish Vaidyanathan Shankar asked for the details of the LinkedIn account from which the impugned post was made and also asked for a report from the Cyber Cell, Delhi Police.
The present matter arose from an alleged LinkedIn post bearing the respondent advocate’s name as the title. Upon being asked as to whether the LinkedIn account belonged to her, the respondent advocate denied the same.
Hence, the Court requested LinkedIn Corporation to disclose the identity and details of the person who had created the said account and uploaded the impugned post. Further, the Court asked the Cyber Cell of Delhi Police to submit a report within two weeks specifying the date on which the post was created, the IP address from which it was posted, the date of its removal, if the same had been removed, as well as the IP address from which it was removed, and the date of creation of the said LinkedIn account.
A copy of the present order was directed to be sent to LinkedIn Corporation and to the DCP, Cyber Cell, for ensuring compliance.
