‘They are Major and Competent to take Decisions’; Delhi HC Directs SHO to Keep an Eye on Couple that got Married Against Father’s Wishes

In a writ petition filed before the Delhi High Court seeking directions to the local police to provide protection to the petitioners, a Single Judge Bench of Justice Girish Kathpalia had a conversation with the parties and directed the SHO concerned to keep a watch on the petitioners so that no harm is caused to them by the wife’s father.

The petitioners were a couple who got married against the wishes of the wife’s father. The Court communicated with the petitioners and noted that they were competent to make their own decisions, as they were of majority age. The wife informed the Court that she had voluntarily married her husband and that they were living a happy life.

The wife’s father submitted that he did not approve of the marital relationship between the petitioners, but assured the Court that he did not intend to cause any harm to the couple. The Court stated that, although the father was genuinely heartbroken by the marriage, his assurance was not unbelievable.

The Sub-Inspector from the petitioners’ residential area informed the Court that the constable’s contact numbers had already been provided to the couple, whom they could call as required. Thus, the Court directed the Registry to redact the names and addresses of the petitioners to ensure their safety, and the SHO was directed to keep a watch on the petitioners so that they are protected from harm.
