Delhi High Court issues Notice on Contempt Plea over Midnight Demolition near Mangolpuri Madarsa

The Delhi High Court has issued notice in a contempt petition filed by the Mangolpuri Muhammadi Jama Masjid and Madarsa Anwarul Uloom Welfare Association, alleging that the Municipal Corporation of Delhi (MCD) carried out a demolition drive around its property at midnight without furnishing the demarcation report mandated by a prior court order.

The petitioner contends that the demolition, which began at 12:00 AM, violated the High Court’s order dated 18.11.2024 in W.P.(C) 4867/2024, which had directed MCD to first indicate the specific encroached area to the petitioner before taking action. They claim that no such report or advance notice was given.

MCD, appearing on advance notice, argued that the demarcation was in fact conducted in the presence of the petitioner, police, and revenue authorities, and that a substantial portion of the encroachment had already been removed in compliance with the court’s earlier order.

The Court directed the MCD to file a detailed reply along with photographic evidence within one week and listed the matter for hearing on 9 July 2025 before the regular roster bench alongside the pending W.P.(C) 4867/2024.

Advocates appearing in the case:

Petitioner: Mr. Kamlesh Kumar Mishra, Ms. Renu & Ms. Mishra Divya Santosh, Advs

Respondents: Mr. Kapil Dutta, Mr. Vansh Luthra & Mr. Siddharth Parashar, Advs. for R1 MCD
