Justice Yashwant Varma, who was transferred to the Allahabad High Court following corruption allegations linked to the recovery of burnt cash from his official residence, has since withdrawn from the ongoing inquiry proceedings after tendering his resignation.

In a 13-page letter to the Judges Inquiry Committee (JIC) under the Judges (Inquiry) Act, 1968, he stated that continuing to participate in the inquiry would amount to legitimising a process he considers fundamentally unfair.

Justice Varma wrote that there is no evidence connecting him to the cash. He asserted that the proceedings relied on presumptions rather than proof and that key witnesses and material evidence were either not examined properly or excluded.

He also raised concerns about the denial of a fair opportunity to defend himself, including the inability to effectively cross-examine witnesses, and criticised the inquiry for reversing the burden of proof. Stating that the process failed to meet standards of fairness and due process, he said he had “no choice but to withdraw” from the proceedings.
