At the 5th ICA International Conference on “Arbitration in the Era of Globalisation,” Shri Arjun Ram Meghwal, Hon’ble Minister for Law & Justice, delivered valedictory address.
He emphasized the government’s commitment to reforming the legal ecosystem to make it more efficient, accessible, and responsive to contemporary needs. He noted the suggestions of the eminent speakers on arbitration reforms, where he expressed agreement with the shift from ad hoc arbitration to institutional arbitration and assured that the government would actively work in that direction. He also acknowledged concerns raised by Mr Khaitan on the need to avoid part-time arbitration practices and to strengthen professionalism in the system.
He took note of issues raised by Justice BV Nagarathna in the morning session on Section 12A of the Commercial Court Act relating to pre-institution mediation and indicated that the government would examine these concerns.
The Union Minister discussed the Jan Vishwas (Amendment of Provisions) Act, 2023 as a significant reform aimed at decriminalizing minor offences and simplifying regulatory processes for traders and entrepreneurs, who previously faced penalties and cumbersome procedures. This reform, he noted, contributes directly to improving the ease of doing business in India.
He further referred to several key legislative frameworks that form part of the broader reform agenda, including the Indian Succession Act, the Insolvency and Bankruptcy Code, labour codes, and the overhaul of criminal laws, all of which aim to modernize India’s legal structure and align it with present-day requirements.
