The Delhi High Court granted an urgent ex-parte ad-interim injunction restraining the Defendant from using the mark “Lenscut ,” holding it to be deceptively similar to Lenskart’s registered trademark. Justice Tejas Karia permitted exemption from advance service of notice, noting concerns that the Defendant may conceal material evidence.
The Plaintiff demonstrated extensive use and promotion of the “Lenskart ” brand since 2008, with registrations across India and abroad. In August 2025, the Defendant was found operating a shop in Pune under the name “Lenscut,” imitating not only Lenskart’s registered logo but also its shop design, “Next Day Delivery” scheme, and promotional elements. Multiple invoices and instances of consumer confusion were placed on record.
The Court appointed a Local Commissioner to inspect the Defendant’s premises without prior notice, authorizing seizure of infringing material with police assistance. The commission was executed on 14 August 2025, and the Plaintiff was directed to comply with injunction requirements within two weeks thereafter. The matter is now listed on 24 November 2025 for further proceedings.
