The National Green Tribunal, Principal Bench, New Delhi, disposed of an Original Application filed by the Applicant, a resident of Vasant Vihar, complaining about the overflowing dhalao outside her residence. The Tribunal observed that if the complaint is made to the Municipal Corporation of Delhi (MCD) showing the garbage overflowing in the dhalao which is causing the health hazards then the prompt action is expected to ensure that the dhalao is properly managed and if an undertaking was given before the Tribunal, then it is required to be duly complied with.
The Applicant submitted that there were four dhalaos in that area and three dhalaos have now been closed down, and hence she claimed that all the garbage of the ward is dumped into the dhalao outside her residence. She further contended that the garbage is now overflowing in this dhalao, which is resulting in foul odour due to the presence of animal excreta and other hazardous material. The Applicant claimed that she, being a cancer patient, had to suffer because of the existing dhalao. She also submitted that the undertaking which was given to the Tribunal and recorded in the proceedings dated 04.09.2023 in the case of Neel Mani v. South Delhi Municipal Corporation for closure of the dhalao has not been complied with, and that in spite of several complaints to different authorities, no action has been taken.
The Tribunal observed that the issue raised required expeditious consideration by the MCD. The Tribunal permitted the Applicant to file a detailed comprehensive complaint along with all supporting material to the Commissioner, MCD, directing that appropriate remedial measures be taken within four weeks of receipt of the complaint. The Tribunal further held that if the Applicant’s grievance remains unredressed, she would be at liberty to approach the Tribunal again.
Accordingly, the bench comprising Mr. Justice Prakash Shrivastava, Chairperson, Dr. A. Senthil Vel, Expert Member, and Dr. Afroz Ahmad, Expert Member, permitted the Applicant to file the complaint and disposed of the Original Application.
