NGT directs Authorities to submit comprehensive response on Illegal Construction in Noida and Greater Noida within three Weeks

The National Green Tribunal, Principal Bench, New Delhi, directed multiple respondent authorities to file detailed affidavits within three weeks regarding action taken against illegal residential and commercial constructions in NOIDA and Greater NOIDA. In the Original Application filed by the Applicant it was alleged that a large-scale illegal construction is in progress, violating the environmental norms, including constructions without requisite environmental clearances, illegal bore wells, and absence of proper sewerage systems.

The Bench comprising Mr. Justice Prakash Shrivastava, Chairperson, Dr. A. Senthil Vel, Expert Member, and Dr. Afroz Ahmad, Expert Member, granted three weeks’ time to various respondents to file comprehensive responses. NOIDA was directed to file a fresh affidavit with all particulars and supporting material, while Greater Noida Industrial Development Authority (GNIDA) and the District Magistrate, Gautam Budh Nagar were also given similar timelines to provide details of action taken against illegal constructions.

The Tribunal observed that the reply affidavit dated 26.03.2025 filed by respondent no.15- New Okhla Industrial Development Authority (NOIDA), though it is vaguely stated that action has been taken against such illegal construction, details of the persons/projects/properties/places against whom action has been taken have not been disclosed. The Tribunal also examined the photographs which have been enclosed along with the affidavit as annexure R-15/3 colly and noted that most of these photographs are old photographs of November, 2022 which is prior to filing of this original application.

Accordingly, the Tribunal directed the Uttar Pradesh Pollution Control Board to carry out extensive inspection of the area concerned and find out projects/constructions which are being done in violation of the environmental norms and initiate action against them. The case was listed on 08.10.2025.
