The Supreme Court on Monday issued notice in a fresh plea challenging the practice of unilateral talaq communicated by post, noting the submission that similar grievances are repeatedly arising across the country
The proceedings concerned a plea relating to a Muslim woman married in November 2024 in Kolkata. Appearing for the petitioner, Dr Syed Rizwan Ahmed contended that despite the woman residing at her matrimonial home, a divorce (talaq) had been unilaterally communicated to her parental home in Delhi, and was being treated as valid, reflecting a pattern seen in multiple cases across the country. Urging the Court to intervene, counsel submitted that similar complaints were arising repeatedly and sought clubbing of the matter with pending petitions.
Taking note of the submissions, the Bench of Chief Justice Surya Kant and Justice Joymalya Bagchi agreed to proceed by issuing notice and scheduling a consolidated hearing, observing, “we are issuing notices in this matter and we will list all these matters which are also pending… we will fix a date for final hearing…in May.”
On the procedural aspect, the Court directed expedited service and noted, “we are issuing notice, and we will issue a dasti notice so that at least pleadings are complete.”
The matter will be taken up on May 19, 2026.
