Transgender rights amendment Act 2026

The Transgender Persons (Protection of Rights) Amendment Act, 2026 has received the assent of the President on March 30, 2026.

The legislation seeks to amend the Transgender Persons (Protection of Rights) Act, 2019, introducing significant changes to definitions, procedures, and penal provisions relating to the rights and protection of transgender persons.

Among the key changes, the Act revises the definition of “transgender person” to include socio-cultural identities and persons with intersex variations, while also addressing instances where individuals are forcibly made to assume a transgender identity through coercive means.

The amendment introduces the concept of a medical authority/board, and modifies the process for issuance of identity certificates by requiring the District Magistrate to consider recommendations of such authority and, where necessary, seek assistance from medical experts.

It further enables individuals recognised as transgender persons to change their first name in official documents, including birth certificates, thereby strengthening identity rights.

The Act also strengthens penal provisions by prescribing stringent punishments for offences such as forced labour, denial of access to public places, forced displacement, and acts endangering the safety and well-being of transgender persons. Notably, severe penalties have been introduced for acts involving coercion or violence aimed at forcing individuals to assume a transgender identity, including imprisonment extending up to life in certain cases.

Additionally, the amendments provide for greater institutional representation by including members from States and Union Territories in the National Council framework and streamline rule-making provisions.

The Act will come into force on a date to be notified by the Central Government.
