On July 29, 2025, the Supreme Court continued hearing a suo motu writ petition concerning the protection of advocates who provide legal opinion or represent clients during investigations from being unnecessarily summoned or harassed by investigating agencies such as the ED, CBI, and the police.
The case, registered as Suo Motu Writ Petition was heard by a Bench comprising Chief Justice of India and Justice K. Vinod Chandran.
The Court noted submissions made by the Supreme Court Bar Association (SCBA), the Supreme Court Advocates-on-Record Association (SCORA), and several senior counsels, who strongly advocated the need for clear guidelines to prevent misuse of process against lawyers merely for discharging their professional duties.
Allowing multiple intervention applications, the Court directed that the written submissions filed by various bar bodies and intervenors be served upon the Attorney General (AG) and Solicitor General (SG) of India within three days.
The matter has been listed for further hearing on August 12, 2025, when the Court will hear responses from the AG and SG before considering the issuance of formal directions or guideline.
