SC Upholds 3-year Suspension of Advocate by BCI for Misconduct; Imposes Additional Cost of ₹ 1 lakh

Advocate Misconduct

The Supreme Court on September 12, 2025, dismissed the appeal filed by the appellant Advocate, who had been suspended by the Bar Council of India for three years on grounds of professional misconduct. The Division Bench comprising Justices Surya Kant and Joymangla Bagchi upheld the suspension, refusing to take any lenient view towards the Advocate.

The case arose from the order dated 19.12.2023, passed by the Bar Council of India, holding the Advocate guilty of professional misconduct and imposing a punishment of three years’ suspension from the roll of advocates maintained by the State Bar Council. The Advocate then approached the Court seeking to quash the suspension, while making scandalous allegations against the complainant-respondent.

The Court, taking note of the obstinate conduct of the Advocate, declined to entertain the appeal. It further directed the Collector of Agra to attach the appellant’s properties and recover a cost of ₹1 lakh, to be paid to the respondent as compensation within three months. The Court also instructed the Bar Council of India not to renew the Advocate’s license without its prior approval. Additionally, it ordered that once the appellant serves the sentence already imposed, a compliance report shall be submitted to the Secretary General of this Court. With these directions, the appeal was duly disposed of.
