The Central Government has notified the Citizenship (Amendment) Rules, 2026, introducing key changes to the framework governing Overseas Citizen of India (OCI) registration and related procedures. The rules were published in the official Gazette and came into force on April 30, 2026.
The amendments modify the existing Citizenship Rules, 2009, particularly in relation to OCI registration, renunciation, cancellation, and record-keeping. A notable addition mandates that minor children cannot simultaneously hold an Indian passport and a passport of another country, reinforcing restrictions on dual nationality in such cases.
The revised framework streamlines the application process by requiring OCI registration applications to be submitted electronically through the designated government portal, replacing earlier procedural formats.
Significant changes have also been introduced to procedural aspects:
- Updated provisions governing renunciation of OCI status, including mandatory surrender of physical OCI cards where applicable.
- Revised rules for cancellation of OCI registration, including compliance obligations when directed by the Central Government.
- Introduction of structured electronic record-keeping systems for OCI registrants.
The rules further provide for review and revision mechanisms against orders passed under the Citizenship Act, ensuring that affected individuals are given a reasonable opportunity to present their case before decisions are taken.
Additionally, updated forms and formats have been prescribed for OCI registration, renunciation declarations, acknowledgments, and maintenance of records, reflecting a shift towards digitisation and procedural clarity.
