In a civil writ petition filed before the Delhi High Court by Emami Agrotech Limited (Emami) after being aggrieved by a proposed action taken after issuance of a show cause notice dated 05-06-2026 and the subsequent letter dated 17-07-2026, a Single Judge Bench of Justice Amit Mahajan directed the respondents not to take any action against Emami till the next date of hearing.
Emami submitted that even though the show cause notice mentioned that the trade name “Emami Healthy & Tasty” was misleading, it had failed to mentioned the manner in which the words healthy and tasty were misleading. It was contended that Emami was given an opportunity to file a reply, which it did on 23-06-2026, but even then, the impugned letter dated 17-07-2026 had been issued without adjudication of the reply.
Emami further submitted that instructions had been given to the State authorities to enforce an action, terming its product as non-compliant of the Food Safety and Standards Act, 2006. It was also argued that actions were arbitrarily taken at the instance of companies selling competitive products.
The Court perused the show cause notice and stated that prima facie no reason was given as to why the petitioner’s usage of the term ‘Healthy and Tasty’ was misleading. Hence, the Court issued notice and directed the respondents not to take any precipitative action till the next date of hearing.
The matter will now be listed on 15-02-2027.
