The Delhi High Court has issued notice on a writ petition filed by the family members of late Captain Sumit Kamal Kapur challenging New India Assurance Company Ltd.’s decision to reject their claim under a Loss of Licence Insurance Policy. The petitioners have sought directions for the release of ₹85.6 lakh under the policy, interest on the delayed payment, quashing of the insurer’s repudiation letter, and an inquiry by the Insurance Regulatory and Development Authority of India (IRDAI) into the alleged arbitrary denial of insurance claims.
The petition seeks a writ of mandamus directing New India Assurance Company Ltd. to forthwith release and disburse ₹85,60,000 in favour of the legal heirs of Late Capt. Sumit Kamal Kapur under Loss of Licence Insurance Policy. The petitioners have also sought payment of interest on the claim amount in terms of the IRDAI (Protection of Policyholders’ Interests) Regulations, 2017, from the expiry of the statutory period for settlement until actual disbursal.
In addition, the petition challenges the repudiation communication dated June 25, 2026, by which the insurer rejected the insurance claim. Besides seeking to set aside the repudiation, the petitioners have urged the Court to direct the IRDAI to conduct a comprehensive inquiry and constitute an Expert Committee/Special Review Committee to examine the alleged wrongful and arbitrary denial of insurance claims by the insurer.
After considering the petition, Justice Jasmeet Singh issued notice to the respondents through all permissible modes, including electronic and dasti service, directing the petitioners to take steps within one week. The matter has been listed for further hearing on August 19, 2026.
