Delhi HC Protects Personality Rights

The High Court of Delhi has granted interim protection to entrepreneur and Shark Tank India judge Aman Gupta against alleged misuse of his personality rights, trademarks and online identity across multiple digital platforms, including AI-generated content, fake endorsements, impersonation accounts and sexually explicit material.

Justice Tushar Rao Gedela passed an ex parte ad-interim injunction in a suit filed by Aman Gupta against several online platforms, unknown persons and intermediaries, observing that the material placed on record prima facie demonstrated infringement of the plaintiff’s registered trademarks as well as his personality and publicity rights.

The Court recorded that Aman Gupta, co-founder of boAt Lifestyle and a long-time investor on Shark Tank India, had acquired substantial goodwill and public recognition through his entrepreneurial ventures, media appearances and commercial engagements. The order notes that Gupta has over 1.7 million Instagram followers, more than 3 million LinkedIn followers and enjoys widespread public recognition as a business personality and youth icon.

According to the suit, several entities were allegedly using Aman Gupta’s name, likeness, catchphrases, voice and persona without authorisation for commercial gain. The alleged infringing activities included fake event booking listings, unauthorised merchandise, AI-based chatbots impersonating him, fake Instagram profiles, circulation of obscene or pornographic content linked to his identity, and publication of purported contact details.

The Court observed that the defendants were exploiting Aman Gupta’s “name, voice, persona, slogans, registered trademarks” and held that these attributes were exclusive to him and none else.

“It goes without saying that the sexually explicit material/videos created by the defendants using the personality traits and attributes of the plaintiff, surely is an aspect which needs immediate and urgent consideration by the Court,” Justice Gedela observed.

The Court restrained the defendants from using his name, image, likeness, voice, videos, GIFs, contact details or any aspect of his persona without express authorisation, including through AI and deepfake technology. It also restrained infringement of his registered trademarks, including “Hum Bhi Bana Lenge” and “Down, But Not Out!”

Further, social media and online intermediaries were directed to remove or block infringing URLs identified in the plaint and disclose details including mobile numbers, email IDs and user account information linked to certain allegedly infringing profiles and pages.

The Court additionally restrained specific defendants from hosting or publishing “obscene, pornographic, morphed, or AI-generated deepfake content” depicting Aman Gupta or using his brand identifiers.

Recognising the evolving nature of online infringement, the Court also granted Aman Gupta liberty to approach the Joint Registrar for impleadment of newly discovered infringing entities and seek extension of the injunction against future violations.

The matter has been listed before the Joint Registrar on August 3, 2026, for completion of pleadings and service and before the court on October 01, 2026.
