A writ petition was filed before the Delhi High Court by Britannia Industries Ltd. (Britannia) after being aggrieved by a communication dated 09-10-2026 by FSSAI, whereby Britannia was directed to remove the claim ‘No Added Sugar’, ‘No Maida’, and ‘No Palm Oil’ from the label of its products i.e. biscuit/cookies.
By a letter dated 02-09-2026, Britannia was asked to show cause as to why the claim ‘100% Millets, ‘No Added Sugar’, ‘No Maida’, and ‘No Palm Oil’ not be declared as misleading and impermissible under Regulation 6(1) of the Food Safety and Standards (Advertising and Claims) Regulations, 2018.
Britannia submitted that after the show cause notice, they agreed to remove the ‘100% Millets’ claim while maintaining the position that their biscuits in fact contains 100% millets. It was also contended that the claims ‘No Added Sugar’, ‘No Maida’, and ‘No Palm Oil’ were factual statements that could not be said to undermine the product of other manufacturers or influence consumers’ behaviour in violation of the Regulations.

A Single Judge Bench of Justice Amit Mahajan issued notice to the respondents and found itself in agreement with Britannia that stating that the product had ‘No Added Sugar’, ‘No Maida’, and ‘No Palm Oil’ could not be alleged to be an advertisement undermining the product of other manufacturers or could influence consumers in violation of the Regulations. It was noted that Britannia had agreed to manufacture and market its product without the claim ‘100% Millets’.
Thus, the impugned order was stayed and Britannia was allowed to produce and market its product. The matter will now be listed on 15-01-2027.
