The Delhi High Court has directed the Deputy Commissioner of Police (DCP) concerned to inquire into the circumstances under which the investigating officer sought permission to travel to Mumbai for the search and arrest of an accused despite the accused being under interim protection from arrest granted by a court.
Justice Prateek Jalan passed the direction while hearing an anticipatory bail application filed by Amit Jain, who had been granted interim protection by the High Court on May 14, 2026. During the hearing, the State submitted that although the applicant had joined the investigation, certain additional documents were required from him. The Court directed the investigating officer to furnish a list of such documents within two days, and the applicant undertook to provide any documents in his possession.
The applicant also placed on record additional documents obtained under the Right to Information Act, 2005, including an official request made by the investigating officer seeking permission to travel to Mumbai “for the purpose of investigation (search and arrest of the accused)“ in connection with the present FIR and another criminal case. According to the applicant, the request was forwarded by the Station House Officer and approved by the Assistant Commissioner of Police on May 8, 2026, during the period when the Sessions Court had already granted him interim protection from arrest.
Taking note of the submission, Justice Jalan directed the concerned DCP to conduct an inquiry and file a report explaining how such a request came to be made and approved despite the subsisting interim protection. The Court also noted that the request appeared to contain “errors and discrepancies,” including with respect to the destination for which permission had been sought.
The Court further permitted the complainant to place additional documents on record and listed the matter for further hearing on July 14, 2026.
