The Delhi High Court has recorded a statement made on behalf of Shivang Edibles Oils Limited that it has stopped using the “DOUBLE SHER” word mark in a trademark infringement suit filed by K.S. Oils Limited concerning the marks “Kalash” and “Double Sher.”
Justice Tushar Rao Gedela was hearing an application seeking ex parte ad-interim injunction against the defendants. The defendants stated before the Court: “Since January, 2026 the defendants have stopped using the ‘DOUBLE SHER’ word mark.”
The Court thereafter directed the defendants to place the statement on affidavit within one week. The Court also directed that the plaint be registered as a suit and issued summons to the defendants.
Additionally, the High Court issued notice in an application filed by KS Oils seeking the transfer of a connected commercial suit pending before the Rohini Commercial Court to avoid multiplicity of proceedings and conflicting findings.
Earlier, Shivang Edibles Oils Limited had filed a trademark suit before the Rohini District Court concerning the “Kalash” mark. KS Oils Limited has now approached the Delhi High Court seeking an injunction against Shivang Edibles Oils Limited over the use of the “Kalash” and “Double Sher” trademarks and has also claimed damages of ₹10 crore.
