Delhi High Court to Hear AISA President Neha’s Plea Challenging Preventive Proceedings on October 22

Delhi High Court Preventive Proceedings

The Delhi High Court is scheduled to hear on October 22 a plea filed by All India Students’ Association (AISA) president Neha challenging preventive proceedings initiated against her by the Special Executive Magistrate, New Delhi District, following her participation in a gathering at Mandi House on October 16.

The petition challenges a notice dated October 17, 2026, issued under Sections 126/130 read with Section 135(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, directing her to show cause why she should not execute a personal bond of ?10,000 with one surety to keep the peace during the inquiry.

According to the petition, Neha was detained by Delhi Police while attending the gathering and released the following morning. The notice cites allegations of sloganeering at Mandi House, repeated protest-related activity around Jantar Mantar despite prohibitory orders, and instigating people to participate in an unauthorised demonstration at Central Park, Connaught Place.

Neha contends that the notice fails to disclose specific material establishing an imminent likelihood of breach of peace, relies on vague and allegedly incorrect allegations, and does not identify the prohibitory order said to have been violated. She has sought quashing of the notice and the proceedings arising from it, along with protection against coercive action.

The plea has been allowed to be listed and is yet to be heard by the High Court.
