Google Tells Delhi HC Dhruv Rathee’s Video Blocked Only In India; Global Takedown Issue Pending Before Division Bench

Google LLC on Tuesday informed the Delhi High Court that YouTuber Dhruv Rathee’s controversial video has been withheld in India, but not globally, as the issue of worldwide takedown orders is pending consideration before a Division Bench.

The submission was made before Justice Swarana Kanta Sharma in a plea filed by Advocate Amita Sachdeva, who alleged only partial compliance with the Grievance Appellate Committee’s (GAC) order directing removal of the video within 24 hours. She argued that YouTube had merely blocked access to the video in India.

Google submitted that it had complied with the GAC’s order to the extent permissible, adding that the question of a global injunction is sub judice before the Division Bench. The Court observed that the issue of worldwide removal would be governed by the Division Bench’s decision.

Appearing for the Centre, ASG Chetan Sharma argued that once content is found objectionable, the takedown order should operate across jurisdictions to prevent repeated litigation.
