Haryana Court Directs Police Officer to Explain Defamatory Social Media Posts on MDU University

Bar Association, Kharkhoda v. Amar Kataria [Decided on 01.08.2025]

The Additional Civil Judge (SD), Kharkhoda passed an order directing a Sub Inspector to submit an affidavit or make a statement regarding the removal of videos and posts from his social media platforms. The suit, filed by the Bar Association, Kharkhoda, seeks damages for defamation and a permanent injunction against misuse of official position by Sub Inspector Kataria for personal promotion.

The controversy stems from videos posted by the sub-Inspector on his Instagram handle, where he made allegedly defamatory statements against law students from Maharishi Dayanand University (MDU), Rohtak, claiming “whosoever gets admission in MDU becomes an Advocate by cheating.” The videos, where he appears in official police uniform and promotes various personal activities, were posted without authorization from the Haryana Police or the State Government.

The sub-Inspector, during the hearing, issued an unconditional apology and assured the court of removing all such content and renaming his accounts to avoid public confusion. He also promised to upload a video apology as a sign of bona fide intent. Sub Inspector Krishan Kumar, appearing for the DGP Haryana, also assured that the matter would be reported to higher authorities to prevent such misuse of uniformed appearances on social media by other officers.

Based on the undertakings, the plaintiff agreed to withdraw the suit conditionally subject to removal of the unauthorized videos. The matter has been adjourned to August 2, 2025, for further compliance.
