Patna High Court Affirms Disqualification of Railway Protection Force (Band) Aspirant Over Missing Time Period in Training Certificate

In a writ petition filed before the Patna High Court by an aspirant for the post of Constable (Band) in Railway Protection Special Force seeking a direction upon the Union of India, the East Central Railway, The Inspector General/Chief Security Commissioner, East Central Railway, and the Nodal Officer, Recruitment of Constable (Band), East Central Railway, to appoint him on the post, a Single Judge Bench of Justice Harish Kumar dismissed the petition for being devoid of merit, holding that any certificate produced could not be considered since the selection process was completed.

Upon being eligible, the petitioner submitted his application and furnished a certificate for two years of experience in specified musical instrument. It was asserted that even though the advertisement stated that document verification would be done after the physical efficiency test and physical measurement test, the petitioner along with other candidates, was called for a Trade Test by the expert on the specific musical instrument of the candidates before the document verification. After verification of documents, the petitioner’s name was not published in the final list despite him qualifying the Trade Test.

The Court noted that a total of 1039 applicants had qualified the written exam and were called for the PET/PMT, out of which 802 candidates qualified. The candidates were then called for the Trade Test in which 148 candidates qualified. As per provisions of Directive-34 two independent co-opted music experts were also nominated. All qualified candidates were called for document verification and the final result was published on 09-01-2020.

It was noted that in the training certificate submitted by the petitioner, the time period of training was not mentioned, which is why it was not taken into consideration. The Court held that now since the selection process was successfully completed, no certificate produced by the petitioner could be considered in any manner.

Thus, the Court dismissed the petition for being devoid of merit.
