In an intra court appeal filed before the Rajasthan High Court against an order dated 27-05-2026 by a Single Judge whereby the appellant’s writ petition challenging his transfer order and relieving order were dismissed, a Division Bench of Justice Ganesh Ram Meena and Justice Pramil Kumar Mathur did not find any infirmity in the impugned order and dismissed the appeal in limine.

The appellant was appointed as a Lecturer (Geography) at Government Senior Secondary School, Kota Road, Baran and had been transferred to Government Senior Secondary School, Phalodi, which was situated at a far distant area. It was submitted that District Baran was one of the aspirational districts notified by the State after the policy decision taken in furtherance of the Aspirational Districts Programme of NITI Aayog, which is why the employees posted in such districts ought not to be transferred or relieved unless a substitute posting is made.

The Court stated that transfer is an incidence of service and that the scope of judicial review in transfer matters is very limited unless the order is shown to be mala fide or in contravention of any statutory provision. It was said that the guidelines relied upon by the appellant were administrative in nature and did not confer any indefeasible legal right upon him.

It was held that the Single Judge had rightly declined to interfere in the matter and the Court did not find any illegality, perversity, or jurisdictional error warranting interference. Thus, the appeal and the stay application were dismissed in limine.
