The Supreme Court Bench comprising Justice Vikram Nath, Justice Sandeep Mehta and Justice A.G. Masih on Tuesday indicated that it was inclined to cancel the bail granted by the Bombay High Court to Ramesh Mhatre, a Shiv Sena corporator accused of assaulting a doctor at a hospital in Kalyan, Mumbai.
The Bombay High Court had granted bail subject to a condition that he would not reside in Maharashtra until charges were framed. It had also fixed timelines for completion of the trial. Pursuant to the order, the corporator has been residing in Goa.
Challenging the High Court order, Mhatre moved the Supreme Court questioning the High Court’s power to prescribe timelines for completion of the trial and seeking relaxation of the condition requiring him to stay outside Maharashtra, so that he could return to Mumbai.
During the hearing, however, the Supreme Court indicated that it was inclined to cancel his bail and directed the State of Maharashtra to file an application seeking cancellation of bail.
The matter has now been listed for September 7.
