During the hearing, concerns were raised regarding the land-related issues and the status of the Union as lessee, with the appellants submitting that developments concerning the land could have a bearing on the issue of the club’s membership and the need for elections.
The Court questioned whether the land issue formed part of the subject matter of the proceedings. The appellants submitted that while it may not directly constitute the subject matter, the developments could affect the issue relating to the rights of the members as the Union is proceeding qua resumption of land. Sr Adv Vikas Singh also said that both lessor and lessee are GOI and club is not represented independently before the High Court.
Following the request for adjournment, the Attorney General assured the Court that nothing would be done until the next date of hearing. The matter was accordingly adjourned.
