The Supreme Court has issued notice on a plea seeking enforcement of the prohibition on advocates advertising their professional services through social media reels, videos and other online promotional content.
A Bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi and Justice V. Mohana sought responses from the Bar Council of India (BCI) and the State Bar Councils, and tagged the matter for further consideration on September 15, 2026.
The petitioners contended that an increasing number of advocates are using platforms such as Instagram, YouTube and Facebook to advertise legal services, showcase client testimonials, and solicit professional work in violation of the Bar Council of India Rules, which prohibit advocates from advertising or soliciting work.
According to the plea, while digital platforms have expanded the reach of legal information, many lawyers have crossed the line between legal awareness and commercial promotion by posting promotional reels, paid collaborations, and content designed to attract clients. The petition argues that such practices undermine the dignity of the legal profession and create an uneven playing field for advocates who adhere to the ethical restrictions.
The petition further seeks directions to the BCI and State Bar Councils to frame and implement effective regulatory mechanisms for monitoring online content by advocates and to take disciplinary action against those found violating the professional code of conduct. After hearing counsel for the petitioners, the Bench passed an order stating:
“
“Issue notice, returnable on 15.09.2026. Dasti, in addition, is permitted.”
The matter is next scheduled to be heard on September 15, 2026.
