The Supreme Court while hearing a batch of Special Leave Petitions emphasised the need for mediation in a protracted family dispute involving claims over movable and immovable assets.
A Bench comprising Justice J.B. Pardiwala and Justice Vijay Bishnoi observed that the litigation between the parties is likely to be long drawn and that a peaceful resolution through mediation would be in the best interest of all stakeholders.
The petitioner, an 80-year-old plaintiff, contended that there was a strong likelihood of the assets in question being divested, necessitating immediate protection. Taking note of these concerns, the Court highlighted the importance of safeguarding the assets during the pendency of the dispute.
While indicating its willingness to hear the matter on merits if required, the Court strongly encouraged the parties to explore mediation as a viable and equitable solution. Notice was issued in the matter, returnable on May 7, 2026, with permission for dasti service.
