Private CCTV Cameras Cannot Be Positioned to Invade Neighbour’s Privacy; Allahabad HC Directs DM to Decide Complaint Within One Month

Yogendra Maurya v. State of U.P, Decided on 26.10.2026

CCTV Cameras and Neighbour Privacy

The Allahabad High Court has held that a private CCTV camera cannot be installed or positioned in a manner that interferes with a neighbour’s privacy, particularly by capturing the entry and exit to their house and the movement of visitors.

A Division Bench of Justice Ajit Kumar and Justice Garima Prashad made the observation while disposing of a writ petition filed by Yogendra Maurya, who challenged the positioning of a CCTV camera installed by his neighbour. The petitioner contended that the camera exposed the entry and exit to his house, thereby interfering with the privacy of persons visiting or leaving the premises.

The Court observed that no private CCTV camera could be installed or positioned in a manner that interferes with a neighbour’s privacy. It directed the petitioner to submit an application before the concerned District Magistrate and ordered that, if such an application is filed, the District Magistrate shall consider and decide it within one month.
