In a special appeal filed before the Allahabad High Court to assail an order dated 09-06-2026 by a Single Judge and to seek permission for the appellant to be permitted to appear provisionally in the main exam for the post of Assistant Teacher scheduled on 13-06-2026, a Division Bench of Justice Rajnish Kumar and Justice Rajeev Bharti modified the impugned order and allowed the appellant to appear provisionally in the exams while directing one OBC post to be reserved during the pendency of the writ petition.
The appellant submitted that the main exam for the post of Assistant Teacher (Male/Female Branch) – Biology was scheduled to be held on 13-06-2026. However, he was debarred from appearing in the same despite having qualified the preliminary exam. It was also submitted that the appellant had applied under the Other Backward Class category and that he had not claimed Sports Quota in the preliminary exam but the same was taken up automatically by the system under the ‘candidate’s other details’ from his One Time Registration.

The appellant asserted that even though the petition had been entertained by the Single Judge by inviting counter-affidavits, the appellant had not been permitted to appear in the exam even provisionally. It was contended that once the exam takes place, even if the appellant’s candidature is found to be fit, he would not get any benefit.
The Court failed to comprehend that a candidate being a district player, who was not a National/International skilled player, would apply under the category of skilled player as he would not get anything out of it. Agreeing with the appellant’s arguments, the Court held that the impugned order was liable to be modified.
Thus, the Court partly allowed the special appeal and modified the impugned order to the extent that the petitioner was permitted to appear provisionally in the mains exam scheduled on 13-06-2026. However, the Court directed that his result was not be declared without the Court’s permission and that one post of OBC category was to be kept reserved during the pendency of the writ petition.
