In a miscellaneous application in a remand application filed before a Special Court at Bombay by Devang Pravin Mody, former Chief Executive Officer and Director of Reliance Commercial Finance Ltd. (RCFL) seeking direction upon the Central Bureau of Investigation (CBI) to provide a copy of the chargesheet filed on 07-07-2026, the Special Judge Nitin V. Jiwane allowed the application and directed CBI to supply a copy of the chargesheet to the applicant.
Devang Mody was arrested by the CBI in relation to a case for offences punishable under Section 120-B read with 420 of the Indian Penal Code, 1860 (IPC) read with Sections 7, 13(2) read with 13(1)(d) of the Prevention of Corruption Act, 1988. He was remanded to CBI custody till 25-06-2026, and thereafter, was remanded to judicial custody. On 07-07-2026, CBI filed a detailed chargesheet arraying Devang Mody as one of the accused persons. It was contested that as per Section 230 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), CBI was obligated to furnish a copy of chargesheet to the applicant without delay within fourteen days from the date of the accused person’s appearance.
The Special Court noted that Devang Mody was produced on 23-06-2026 while being remanded to CBI custody on 25-06-2026 and that the applicant was then remanded to judicial custody till 08-07-2026, which was extended till 20-07-2026 and 03-08-2026. It was found that CBI had filed the chargesheet in Court, meaning that the same had been duly scrutinized and was registered.
It was stated that since Devang Mody was one of the accused, he was entitled to a copy of the chargesheet filed by CBI to take necessary legal assistance for defending himself. The Court said that no prejudice would be caused to CBI if the same is supplied to the accused. Hence, the miscellaneous application was allowed, and CBI, BSFB, New Delhi was directed to supply a copy of the chargesheet through electronic means to the applicant.
