IBC Amendment Act, 2026: Centre Notifies Key Provisions Effective From May 26

IBC amendment provisions notified

The Central Government has notified the enforcement of key provisions of the Insolvency and Bankruptcy Code (Amendment) Act, 2026, bringing a substantial part of the amendment framework into force from May 26, 2026. The notification, issued by the Ministry of Corporate Affairs under Section 1(2) of the Amendment Act, specifies the provisions that will now become operational.

As per the notification, a wide range of provisions spanning Sections 2 to 6, 8 to 33, 35 to 39, 43 to 44, 48 to 59, and 61 to 66, along with certain specific clauses under other sections, have been brought into effect.

The notified provisions include the legislative changes concerning insolvency resolution processes, procedural reforms, and operational amendments introduced through the 2026 amendment legislation. Certain portions of Sections 34, 69, 70, and 72 have also been operationalised, while sub-clause (xx) of clause (b) of Section 70 has been expressly kept out of the present notification.
