A Delhi Court has stayed the operation of an order directing registration of an FIR against Renuka Varma, pending adjudication of her criminal revision petition challenging the direction issued by a trial court under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
Additional Sessions Judge Shefali Barnala Tandon passed the interim order in Criminal Revision which challenges the April 25, 2026 order of the Judicial Magistrate First Class, Patiala House Courts. The trial court had allowed an application under Section 175(3) BNSS and directed the concerned SHO to register an FIR against Varma.
Appearing for the revisionist, advocates Prateek Som and Chaitanya Tripathi argued that unless the impugned order was stayed, the revision petition would become infructuous if the FIR were registered in the meantime.
Accepting the submission at the interim stage, the Sessions Court stayed the operation of the impugned order till disposal of the revision petition. Notice has been issued to respondent No. 2, while the Additional Public Prosecutor accepted notice on behalf of the State.
The matter has now been listed for July 9, 2026, for appearance of respondent No. 2, filing of reply, and arguments on the revision petition.
