The Delhi High Court has condoned an 88-day delay in filing the written statement in the Delhi Gymkhana matter and directed that the written statement be taken on record along with the affidavits concerning admission and denial of documents.
The Court noted that the delay fell within the 120-day statutory period and, after hearing the objection to the application for condonation of delay, allowed the application.
The Court also dealt with several pending applications, including applications under Order XXXIX Rules 1 and 2 CPC, directing replies and rejoinders, where required, to be filed before the next date of hearing.
In relation to an application seeking amendment of the pleadings, the Court noted that notice had already been issued and directed the defendants to file their replies, with rejoinders, if any, before the next date.
The Court further clarified that an assurance recorded on May 26, 2026, regarding keeping proceedings in abeyance/deferred, would continue. It observed that if there is any dispute regarding the assurance, the matter could be placed before the same Bench; otherwise, the proceedings would continue on the next date.
