The Delhi High Court on Thursday issued notice to Himani Puri on an application seeking vacation of an interim injunction granted in her defamation suit over articles linking her to convicted sex offender Jeffrey Epstein.
Justice Mini Pushkarna directed Puri to file a reply on the application moved under Order XXXIX Rule 4 of the Code of Civil Procedure (CPC), which seeks setting aside of the temporary injunction.
Senior Advocate Vikas Singh, appearing for the defendant Kunal Shukla, argued that the mandatory requirements under Order XXXIX Rule 3 CPC requiring notice to the opposite party before grant of injunction had not been complied with. He further contended that the Court is obligated to decide such injunction applications within 30 days.
The Court, however, issued notice on the application and posted the matter for hearing on May 7, indicating that a “practical order” would be passed.
