Delhi High Court Seeks X User’s Reply on Gaurav Bhatia’s Plea to Remove ‘Obscene’ Post on his TV Appearance

obscene video takedown defamation plea

The Delhi High Court sought a response from an X (formerly Twitter) user on a plea filed by Senior Advocate and BJP leader Gaurav Bhatia seeking removal of allegedly obscene content linked to his television appearance.

Justice Mini Pushkarna directed the user, identified as ‘Ranting Gola’, to file a reply within two weeks. The plea alleges that the user uploaded a video in December 2025 in wilful disobedience of an interim injunction granted in Bhatia’s defamation suit.

Appearing in person, Bhatia contended that the content uses “obscene and sexually suggestive language” and cannot be justified under the right to free speech. He argued that continued circulation of the video causes ongoing harm to his reputation and sought directions for takedown, along with coercive measures including attachment of property and civil imprisonment.

Opposing the plea, Advocate Vrinda Grover and Nakul Gandhi, appearing for the user, submitted that the interim order had not been duly served. This was disputed by Bhatia, who claimed service was effected via the platform.

The Court has listed the matter for further hearing on May 18.

Notably, in an earlier order dated September 25, 2026, the High Court had directed removal of certain obscene posts against Bhatia while declining to impose a blanket restraint on satirical content, drawing a distinction between defamatory/obscene material and protected expression.

Appearances:

Advocates Vrinda Grover, Nakul Gandhi, Soutik Banerjee, Devika, Gurdeep Singh and Siddhi Sahoo appeared for the user.

Senior Advocate Gaurav Bhatia and Advocate Raghav Awasthi appeared for Bhatia.
Adv Talha Rehman appeared for Samajwadi Party (Defendant No.1).
