Delhi HC Dismisses Pleas Seeking FIRs Against Politicians Over Alleged Hate Speeches Linked to 2020 Delhi Riots; Rejects SIT Probe Into Jamia Police Action

The Delhi High Court on Monday dismissed a batch of petitions seeking registration of FIRs against politicians for alleged hate speeches in connection with the 2020 North-East Delhi riots, as well as petitions seeking an independent probe into alleged police atrocities at Jamia Millia Islamia during the 2019 protests against the Citizenship Amendment Act (CAA).

A Division Bench comprising Justice Vivek Chaudhary and Justice Manoj Jain dealt with multiple petitions seeking investigation into the circumstances leading to the riots, which claimed over 50 lives.

One petition filed seeking registration of FIRs against BJP leaders including Anurag Thakur, Kapil Mishra and Parvesh Sahib Singh Verma over speeches allegedly delivered during the CAA-NRC protests. Another petition filed by Lawyers’ Voice sought prosecution of opposition leaders including Rahul Gandhi, Sonia Gandhi, Manish Sisodia and Asaduddin Owaisi, as well as a retired High Court judge.

The Bench also dismissed petitions seeking a court-monitored SIT probe into the alleged role of the Delhi Police during the riots, including pleas filed by CPI(M) leader Brinda Karat and Jamiat Ulama-i-Hind.

Separately, a plea by activist Ajay Gautam sought an investigation by the National Investigation Agency (NIA) into the protests, alleging an international conspiracy and foreign funding of activists.

The Court also dealt with petitions filed by students of Jamia Millia Islamia seeking an SIT investigation into alleged police atrocities inside the university during the 2019 anti-CAA protests.
