Delhi HC Directs Authorities to Include 20 Super Specialty Seats Vacated by NEET-SS 2025 Candidates in Stray Vacancy Round

The Delhi High Court has directed the authorities to ensure that 20 Super Specialty seats allotted to candidates who no longer wish to pursue their courses through NEET Super Speciality Examination 2025 are included in the stray vacancy round of counselling, observing that the seats should not go vacant.

Justice Jasmeet Singh was hearing a petition filed by doctors who had secured seats through the Round-2 All India Quota counselling for Super Specialty courses but sought permission to withdraw from the allotted seats without being subjected to a seat-leaving bond, financial penalty or debarment. They also sought release of their original documents and refund of fees deposited with the respective colleges.

The petitioners submitted that they were not interested in pursuing the courses, stating that the courses were demanding and that they were unable to cope with the stress.

The Court, while issuing notice, directed the respondents to ensure that the seats allotted to the petitioners are put up for the stray vacancy round of counselling, so that the 20 Super Specialty seats do not remain vacant or go to waste.

At the same time, the Court did not decide the petitioners’ challenge concerning the seat-leaving penalty, bond or debarment at this stage. It directed that the issue of penalty would be adjudicated after the respondents file their counter affidavits.

The respondents have been granted four weeks to file their counter affidavits, and the matter has been listed for further hearing on November 23, 2026.
