Delhi High Court Issues Notice on Limited Prayers in Congress Plea Challenging Denial of Permission to Hold Protest

Delhi HC Protest Permission Challenge

The Delhi High Court, before Justice Amit Mahajan, is hearing a plea by the Indian National Congress challenging the denial of permission to hold a protest.

Senior Advocate Sidharth Luthra, appearing for the Congress, pressed for consideration of prayers challenging the application of Standing Order No. L&O/48/2022 to prohibit peaceful assemblies without an individualised assessment.

The petition seeks, among other reliefs, a declaration that the Standing Order cannot be applied to impose an automatic or disproportionate prohibition on peaceful assemblies, a direction for fresh consideration of the protest request, and a clarification that the ten-day notice requirement cannot operate as an absolute bar where shorter-notice applications may be considered under the Standing Order.

The Court issued notice only on limited prayers, including those concerning the interpretation and application of the Standing Order, rather than the entire set of reliefs sought in the petition.

The matter is stated to be listed on November 17.
