Delhi HC Admits Kejriwal’s Fresh Affidavit in Recusal Plea Against Justice Sharma

Former Delhi Chief Minister Arvind Kejriwal has filed an additional affidavit before the Delhi High Court reiterating his request for the recusal of Justice Swarana Kanta Sharma from hearing the CBI’s appeal against his discharge in the excise policy case.

The affidavit was submitted a day after the Court reserved orders on the recusal plea following detailed arguments. Kejriwal has raised concerns over a potential conflict of interest, pointing to the professional engagements of the judge’s immediate family members with the Central government’s legal establishment. According to the affidavit, the judge’s son is empanelled as a Group A counsel for the Centre before the Supreme Court, while her daughter serves as a Group C counsel for the Centre and is also a government pleader before the Delhi High Court.

Kejriwal has further contended that both are assigned cases by Solicitor General Tushar Mehta, who is appearing for the Central Bureau of Investigation (CBI) in the present matter and opposing the recusal plea, thereby raising apprehensions of bias. The High Court has already reserved its order on the recusal application.
